Booking Simple is an online event ticketing platform operated by:

For these Organiser Terms & Conditions, "Booking Simple", "we", "us" and "our" mean Trinity Group of Consultants Pty Ltd in its capacity as operator of the Booking Simple platform.
"Organiser", "you" and "your" mean the individual, business, company, organisation or other legal entity creating, publishing, promoting, selling tickets for or managing an event through Booking Simple.
By creating an Organiser account, submitting an event, publishing an event, connecting a payment account, accepting bookings or selling tickets through Booking Simple, you agree to these Organiser Terms & Conditions.
If you are acting on behalf of an organisation, you confirm that you have authority to enter into these Terms on behalf of that organisation.
The Organiser is responsible for the creation, management, promotion and delivery of its event.
The Organiser is responsible for:
Unless expressly stated otherwise, Booking Simple acts as a ticketing technology platform and is not the organiser, producer, promoter, venue operator or performer of events listed on the platform.
Booking Simple may require Organisers to provide business, identity, payment or event information before an event can be published.
Booking Simple may review events before publication.
We may approve, reject, suspend, unpublish or request changes to an event where reasonably necessary, including where:
Approval of an event by Booking Simple does not constitute an endorsement, guarantee or acceptance of responsibility for that event.
Organisers must provide accurate and up-to-date event information, including where applicable:
The Organiser must promptly update information if material event details change.
The Organiser determines the face value of tickets for its events.
Ticket prices and any Organiser-controlled mandatory charges must be accurately disclosed.
Booking Simple may apply separate booking, ticketing, transaction or platform fees in accordance with Booking Simple's published pricing or any separate written agreement with the Organiser.
Booking Simple may charge platform or ticketing fees for paid transactions.
Depending on the configuration available to the Organiser, these fees may be:
Payment processor fees charged by providers such as Stripe or Square are separate from Booking Simple platform fees unless expressly stated otherwise.
Applicable Booking Simple fees will be disclosed through the platform, applicable pricing page, Organiser agreement or event configuration.
Customer payments may be processed through supported third-party payment providers including Stripe, Square or other payment providers made available by Booking Simple.
The Organiser may be required to establish, verify or connect an account with the applicable payment provider.
Payment processing is also subject to the payment provider's own terms, policies and verification requirements.
Third-party payment providers may:
Booking Simple does not guarantee that a payment provider will approve or maintain an Organiser's merchant account.
Organiser payouts are subject to successful payment processing and the settlement rules of the applicable payment provider.
Payouts may also be affected by:
Booking Simple is not responsible for delays caused solely by banks, card networks or third-party payment processors.
The Organiser is responsible for establishing and administering its event refund and cancellation policy, subject to Australian Consumer Law.
Nothing in an Organiser's refund policy can remove rights that a customer has under applicable law.
If an event is cancelled, materially postponed, rescheduled or materially changed, the Organiser is responsible for providing appropriate remedies to customers as required by applicable law.
Booking Simple may assist with communicating event changes and processing refunds through the applicable payment system.
Refunds may also be subject to the policies and processing rules of the relevant payment provider.
If a customer disputes a transaction or initiates a chargeback relating to an Organiser's event, the Organiser must reasonably cooperate with Booking Simple and the applicable payment provider.
The Organiser may be required to provide evidence relating to:
To the extent permitted by law and the applicable payment provider's rules, costs arising from refunds, disputes or chargebacks attributable to the Organiser may be deducted from amounts payable to the Organiser or recovered from the Organiser.
The Organiser is responsible for determining and complying with its own tax obligations, including GST, income tax and reporting obligations.
The Organiser is responsible for ensuring that ticket prices, GST treatment and any tax information entered into Booking Simple are correct.
Booking Simple does not provide accounting, taxation or legal advice to Organisers.
Organisers may receive customer information reasonably necessary to administer their events.
Organisers must:
Customer information accessed through Booking Simple must not be misused.
Purchasing a ticket does not automatically provide an Organiser with unrestricted permission to send promotional marketing communications to a customer.
Where consent is required, the Organiser is responsible for obtaining and respecting that consent.
Organisers must comply with applicable Australian electronic marketing and spam requirements, including unsubscribe requirements where applicable.
The Organiser retains ownership of event content it uploads to Booking Simple.
By uploading content, the Organiser grants Booking Simple a non-exclusive licence to use, display, reproduce and distribute that content as reasonably necessary to:
The Organiser confirms that it owns or has permission to use all uploaded content, including:
Booking Simple must not be used for unlawful, fraudulent, deceptive or misleading activities.
Booking Simple may refuse, suspend or remove events that:
Booking Simple may provide QR-code ticketing and check-in functionality.
The Organiser remains responsible for event entry management, including:
The Organiser is responsible for maintaining appropriate access controls for Organiser and Checker accounts.
Organisers are responsible for maintaining the security of their Booking Simple account and login credentials.
Organisers must promptly notify Booking Simple if they become aware of:
Booking Simple does not provide event insurance to Organisers.
Organisers are responsible for determining what insurance is appropriate for their activities.
Depending on the event, this may include:
The Organiser is also responsible for complying with any insurance requirements imposed by its venue or other suppliers.
Booking Simple aims to maintain reliable platform availability but does not guarantee uninterrupted access at all times.
Temporary disruptions may occur because of:
Booking Simple will use reasonable efforts to restore affected services.
Booking Simple provides technology that facilitates event discovery, ticket booking, payment processing integration, ticket issuance and event-management functionality.
Unless expressly stated otherwise, Booking Simple does not:
The contract for attendance at an event is primarily between the Organiser and the ticket purchaser, subject to applicable Booking Simple terms and applicable law.
To the maximum extent permitted by law, Booking Simple is not responsible for losses arising solely from:
Nothing in these Terms excludes, restricts or modifies rights, guarantees or remedies that cannot lawfully be excluded under Australian law.
To the extent permitted by law, the Organiser is responsible for claims, losses, liabilities or reasonable costs arising from:
except to the extent that the loss was caused by Booking Simple's own negligence, unlawful conduct or breach of its obligations.
Booking Simple may suspend or terminate an Organiser account where reasonably necessary because of:
Where reasonably practicable, Booking Simple will notify the Organiser of the reason for suspension or termination.
Outstanding responsibilities relating to existing customers, bookings, refunds, disputes or payments continue after suspension or termination where applicable.
Booking Simple may update these Organiser Terms & Conditions from time to time.
Material updates may be published on the Booking Simple website or communicated through the platform.
The version legally applicable to an Organiser will be the version accepted or otherwise applicable at the relevant time.
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
These Organiser Terms & Conditions are governed by the laws of Victoria, Australia.
The parties submit to the jurisdiction of courts and tribunals having jurisdiction in Victoria, subject to any mandatory rights under applicable law.
